            The criminal law is essentially a law of the punishment. Punishment by its definition means to inflict pain. The process of criminal justice punishment is often borne out of a criminal justice process that seeks to determine the offense and provide a justified form of punishment according to a certain set societal codes. However, there have been great differences among the philosophers as to whether it is right or wrong to inflict pain to those who go against the societal set codes. This has created two groups, those who believe that inflicting pain is fundamentally different from inflicting pain to the innocent, and the other groups that believe that punishment can be justified only if it leads to a greater good. This has created the utilitarian and retributive approaches towards punishment.  

            The utilitarian rationale of punishment is based on the assumption that it is evil and is justified through the greater benefits that arise. According to (Pollock, 2009) under the utilitarian rationale, it is believed that the good is that that has a benefit to the many. This would mean that even if a form of punishment would be so painful to the offender, it would be considered good if it produces the greatest good to the many. Pollock (2016) further points that utilitarian views punishment as evil and that it is only justified if it produces greater good than the evil to the society. The utilitarian rationale of punishment seeks to punish the offenders in order to deter or discourage the possibility of such crimes arising in the future. Community Corrections’ primary function and mission is to protect the community by supervising offenders and reporting non-compliance to the sentencing or releasing authority. A probation officer conducts investigations, including pre-sentence investigations, other state investigations and violation reports. For this week’s Assignment you will write a report outlining appropriate referrals which will assist the below offender, Larry Greene, with available resources.
Consider the following offender profile.
Mr. Greene has little motivation to accomplish many things in life. At 20 years old, he has completed some courses at the local community college and maintained a 2.85 GPA. Mr. Green’s parents are very supportive of him, always providing parental guidance and love needed to progress through life. Mr. Green is unmotivated to achieve much in life and likes to spend his days with his friends that are equally unmotivated.
