  • Doctoral learners are required to use APA style for their writing assignments. The APA Style Guide is located in the Student Success Center. 
  • Refer to the Publication Manual of the American Psychological Association for specific guidelines related to doctoral-level writing. The manual contains essential information on manuscript structure and content, clear and concise writing, and academic grammar and usage. 
  • You are required to submit this assignment to LopesWrite. Refer to the LopesWrite Technical Support articles for assistance.

Directions:

Locate the Synthesis Paper you completed in Topic 5. Using the feedback provided by your instructor and information from the two additional articles you selected, write an Enhanced Synthesis Paper with Reflection (1,250-1,800 words). Include the following in your paper:

The four experiences listed in the HBR article can be broken down into four main points: Creating a Culturally Sensitive Corporation, Diversifying Talent to Suit the Market,  Standardizing HR Practices Around the World, and Shifting the Focus to Emerging Markets.

I believe that through all four shared experiences there are similar key takeaways. One is that HR practices need to be flexible as Shane Tedjarati discusses the global strategy for Honeywell, we see that in their strategy the needed to be flexible. The board members needed to open their minds to seeing things from a different perspective in order to make their mark in new regions. Luc Minguet also references flexibility in its training of managers. This flexibility can also be used in how we interact with one another. Management especially needs to have an understanding on how to speak with employees who may have different cultural backgrounds. If a company is going to be entering the global market, they need to be trained on how to change their approaches to suit the culture of that country. They cannot have a universal approach. Eduardo Caride talks about moving managers across borders. Managers would need to be flexible with making the move to other countries. As Caride notes, this always new management to change some of the mindsets of the local employees. It can help them to see other perspectives and be open to new ideas. Takeo Yamaguchi’s talk about standardizing HR practices discusses using new systems and idea of creating the same performance management across all business units. This change requires employees to become comfortable with a big change. Again, flexibility comes into play. This time it is in an effort to make HR more streamlined and fair for all.

I think the take away’s from this article can apply to domestic HR as well. Flexibility, open-mindedness, training and creating standardized HR practice is valuable to all companies. If the company is domestic only the application of these ideas will be a little different then those expressed in the article but they have the same result. They will create a better company culture, increased markets and a more effective HR department as well as a more successful company overall.

2) The four experiences discussed in the HBR article all come down to two things, communication, and active listening. All four discussions posed a difficulty in their global organizations. When sending expatriates to manage in their other locations, one of the largest benefits to success was sharing information with others that can benefit the company as well as informing others about one’s management style so those around them understand. Once these points were established, the expatriates listen to how those in the foreign country work to understanding the new culture. This assists both the new management team or the expatriate and the employees to understand and adapt to their new work environment. We can use the information from these prior experiences to benefit purely domestic US organizations. While we cannot change the fact that US employees respond better to sugarcoated negative feedback, we can use the other experiences listed as beneficial information. Organizations can always benefit from communication and active listening. Knowing that employees working in a domestic US organization are US citizens, there are times we find that employees are not from the same zip code the organization is located or that the service/product is sold. So, when looking into why one product sells better in one area vs. another area in the US we must investigate the environment, those who surround the stores we sell and so on. To explain my point from my own personal experience; I live in Hammonton, nicknamed “the blueberry capital of the world”, a place where you cannot drive a mile without seeing a farm or know someone who does not have one. I have a farm, my best friend has one, my property is lined by the property of a farm owned by another farmer that lines up next to another farmer’s land. Most of the kids’ first jobs in this town is blueberry picking, as was mine. A farmer on the opposite side of town opened a blueberry farm where you pay the farm to go and pick your own blueberries. I have personally never seen a car there except for the weekend and it has mostly been three cars there. I always wonder “Why would I, pay you, to work for you?” However, the reason the weekends have any customers at all is because people from out-of-town drive there to enjoy this “experience”. One could imagine that if a self-pick farm was placed in an area that was not entirely populated with farmland, it would bring in so much more money because it would be a new experience to the community that surrounds it. Otherwise, if you are not from the area and live under a rock, you may not understand this concept because you did not grow up doing that job

Q1/ In my opinion, constitutions, in short, are frameworks for making politics possible. The text of a written constitution contains different kinds of legal norms that create the basic framework. These norms include rules, standards and principles. Rules and standards exist along a continuum. Rules are norms that don’t require very much practical reasoning to apply.

Like standards, principles may also have abstract and vague terms; the difference is that when principles apply to a situation, they do not always apply conclusively, but may be balanced against other considerations.

A constitution contains a mixture of these different kinds of norms. They serve different functions. For some purposes, rules are better than standards or principles. Otherwise presidents would tempted to try to stay in power forever, and this might undermine democracy. But some constitutional goals cannot easily be achieved through rules. That is why human rights provisions in constitutions are usually expressed in terms of standards and principles. These are open-ended, abstract, or vague terms that necessarily require construction and implementation by later participants in the system.

Constitutions use rules, standards, and principles and to channel and police government action, to establish rules of succession to power, to create institutions that perform government functions, to divide powers among different actors and branches, and to set institutions in competition with each other in order to diffuse and check concentrations of power. Because constitutions not only use rules but also standards and principles – and because they are sometimes silent on certain questions – they are elaborate systems of constraint and delegation to the future.

I believe that we must be faithful to the original meaning in the sense of the original semantic and communicative content of the words. But it does not follow that we must apply the constitution’s words in the same way that they would have been applied by the people who wrote them. Thus, the Fourteenth Amendment to the U.S. Constitution guarantees equal protection of the laws. These words have pretty much the same semantic meaning as they did in 1868. But the people who wrote them did not expect that the words would require modern notions of sex equality. In applying the Equal Protection Clause today, we are bound only by the original meanings of the words – which in this case is the same as the contemporary meaning – and not the original expected application.

Because a constitution is a framework, it must be built out over time, and different generations must participate in that project. As each generation gets involved, change inevitably occurs. Moreover, many different people and groups in society participate in the construction of the constitution– not only judges and lawyers, or politicians, but also members of civil society and ordinary individuals.

These groups participate in official ways: for example, by creating laws and judicial doctrines. They also participate in unofficial ways: for example, through social influence, political organization, and cultural change. To understand constitutional development, we must take account of both the official and the unofficial contributions to constitutional construction.

Anyone approaching the topic of constitutional interpretation inevitably encounters the question of whether it has some specific trait that distinguishes it from other objects or forms of legal interpretation. Whatever the theory of legal interpretation to which one adheres, whether one regards it as a function of knowledge or as a function of the will, one necessarily presupposes that the constitutional interpretation is a species of the genus “ legal interpretation ”and one seeks to distinguish it from other species of the same genus, the interpretation of laws, that of international treaties, administrative acts, or contracts of private law.  But, if the question is always the same, the type of answer one gives depends in part on the theory of interpretation on which one relies. 

     Thus, those who believe that interpretation is a function of knowledge are obviously tempted to seek the specificity of constitutional interpretation in the specificity of its object. As the constitution is not a text like any other, constitutional interpretation is different from the interpretation of laws or treaties. In this regard, theorists who adhere to an intermediate or mixed theory agree with the proponents of interpretation-knowledge theory. According to the intermediate theory, in fact, interpretation is an act of will by which the authentic interpreter chooses within a frame among several possible meanings, while the determination of the frame would result from an act of knowledge.

     Americans constitutional theory presents an opposition between, on the one hand, the arguments in favor of a living constitution capable of adapting to change, and, on the other, the demand to restore the original meaning of the constitution. these two positions stem from a common observation: the recognition of the disappearance of the world which produced the old constitution. This experience of constitutional modernity gives rise to equal and opposite tendencies: the need to cling to the past, its symbols, and its concrete manifestations on the one hand and, on the other hand, the need to transcend the past through adaptation  pragmatic to a world that is no longer the same

Read chapter 9 of the class textbook and review the attached PowerPoint presentation.  Once done present an analysis of the following case study answering the questions below.

Mrs. Li Huan, a 79-year-old Chinese American widow who lives alone in New York City’s Chinatown recently had a cerebrovascular accident (CVA) or stroke. Mrs. Li has right-sided paralysis with partial loss of voluntary movement and sensation in her right arm and leg. Mrs. Li has weak facial muscles, difficulty with speech, and drooling. She experiences numbness and tingling in her arms and legs. Mrs. Li is going to a rehabilitation center known for delivering culturally competent interprofessional care where she is cared for by a team of credentialed health care providers: Dr. Indira Patel, nurse J.J. Johnson, physical therapist Mohammad Abu Said, dietician Maria Gonzalez, and Chinese American herbalist, Chen Minzhe.

(Note: In traditional Chinese culture, a person’s last name or surname is written first, followed by his/her first name. Therefore, the patient’s last name is Li and the herbalist’s last name is Chen. It is proper etiquette to call a person of Chinese background by his/her title, in this case, Mrs. Li and Mr. Chen until the individual gives you permission to use his/her first name. To further confuse matters, many acculturated Chinese Americans are likely to reverse their first and last names in the typical US or Canadian order. Therefore, it is important to ask the patient, “What is your first name? What is your last name?” Note the correct order on the patient’s chart for other members of the team.)

  1. How do members of the interprofessional team assess Mrs. Li’s literacy, diet, and medications, including herbal medicines being provided by her herbalist, Mr. Chen?
  2. How do the nurse and other members of the team determine if complementary or integrative treatments, such as medicinal herbs, are helpful, harmful, or neutral to Mrs. Li’s recovery?
  3. If you were seeking advice or consultation from a traditional Chinese herbalist in your community, how would you locate one?
  4. Why do patients seek treatment from alternative and integrative healers?
  5. How can credentialed health care providers work collaboratively with Mr. Chen to ensure that prescription medicines and herbs are compatible and that there are no adverse or harmful interactions between various medicines?
  6. What strategies would you recommend in promoting Mrs. Li’s optimum functioning and health following her CVA? (Andrews & Boyle, Transcultural Concepts in Nursing Care, 7th Edition).
