Consider the following topics. In many U.S. communities, low-income populations use the emergency room instead of going to a physician or mid-level provider’s office. They often do not pay the bill for their service, which shifts the cost of their care to other, paying patients at the hospital. This practice drives up the cost of health care, but what else can hospitals do? They have to have a certain amount of income to keep their doors open. Is this fair? What if these sick people remain untreated and infect others? Is this just? Do they deserve care so that they don’t infect others? We talk about a culture of poverty in this country. What does this mean to you? What about those people who seem to bilk or misuse the health care system? Do they deserve care? If so, who should pay for it? Shouldn’t everyone be forced to carry health insurance so that everyone has a pay source? Can we expect people to pull themselves up by their bootstraps?

  • What does social justice mean to you? Is social justice the same as socialized medicine or even communism?
  • The notion of social justice is fairness so that everyone can achieve a certain level of health and wellness. After all, the Constitution guarantees everyone the right to pursue happiness. Is the health care system fair?

There are various similarities and differences between laws and the judiciary systems of the United States and the United Kingdom. This paper looks at these in terms of substantive and procedural laws as well as judicial review.

  1. Substantive Law

Substantive law is the laws that determine how a society behaves. The law includes civil and criminal laws. Civil law encompasses rights and responsibilities while criminal law encompasses crimes and punishments. Substantive law refers to the actual claims and defenses and is captured in statutes and precedents (McDonald, 2000).

In the United States, both civil and criminal cases go through the same court system at the federal levels; with federal courts having precedence over state courts. In most states, there are usually different courts for civil and criminal cases. Cases will proceed from the magistrate courts, district courts, appealscourts and on to the Supreme Court.

This is akin the United Kingdom, though there are separate courts for civil and criminal cases throughout. Civil cases are handled at the magistrate and county courts while criminal cases are handled at the magistrate and Crown courts. More serious cases of both civil and criminal nature proceed to different divisions of high, appeal and Supreme courts(McIntyre, Farmer and Deacon, 2015). The United Kingdom also has the tribunal system that is not present in the United States court system.

Both the United States and the United Kingdom rely on past decisions as authoritative precedents for litigation. These are referred to as “opinions” or “cases” in the United States and “law reports” in the United Kingdom. Apart from precedents, the United States relies on the Congress for legislation while the United Kingdom relies on the House of Parliament(McIntyre, Farmer and Deacon, 2015).

  1. Procedural Law

Procedural law is the procedures for making, administering and implementing substantive law.  It includes how a court hears and rules on proceedings: civil, criminal or administrative. Procedural law sets the rules to determine validity of claims and defenses in substantive law(McDonald, 2000).

In the United States, procedural law is guided by due process of the Constitution while in the United Kingdom it is guided by fundamental justiceof common law. So while procedural law in the United States aspires to ensure fairness and consistency of due process, in the United Kingdom it strives towards fundamental justice.

Laws in the United Kingdom, like in many other European countries, have been greatly influenced by the Roman laws. This includes the issue of the procedural “actio”, where the substance of procedural and substantive laws is united, with the existence of procedure determining existence of substantive. While this unity of the laws was evident in the English system of writs, it is now non-existent; both in the United Kingdom and the United States(McDonald, 2000).

  1. Judicial Review

The judiciary can reviews executive and legislative actions. This process, known as judicial review, may involve a court invalidating the executive decision or legislative statute for being unlawful or violating a written constitution.

            Serious crimes perpetuated often produces great impact on the victims and their families. According to Huang (2018) the victims of violent crimes together with their families often suffer physically and psychologically. Suffering is not restricted to the victims of violent crimes, but can have adverse effects on other victims such as rape victims, and victims of burglary. However, all the victims regardless of the nature of victimization require some assistance to cope with life after crime. The federal government has come up with numerous programs that target towards justice restoration among the victims of violence. One such program that is currently being employed is the Victim Assistance and Involvement Program.

            The role that a victim plays in the criminal justice process is continually a subject of discussion. Underwood and Edmunds (2003) points out that the roles of the victims have been reduced to that of an obscure bystander. The Victim Assistance and Involvement Program is one of the federal restorative programs that were initiated to create a balance and offer the victims some form of voices. According to Centre for Justice and Reconciliation (2020) the Victim Assistance and Involvement Program offers assistance to the victims when they are undergoing recovery from crime and when they were undergoing the justice process. The program has two major roles; acts as an advocate for the rights of the victim during the justice process and provide the necessary community support to avert personal crises that results from victimization.

            The major purposes of the Victim Assistance and Involvement Program are to provide legal representation to the victim so that they do not fall victims of re-victimization to the system neglect (Centre for Justice & Reconciliation, 2020).  The author asserts that the program helps in meeting the physical and psychological needs of the victim after they have been subjected to criminal acts. In addition, the Victim Assistance and Involvement Program provide the victims with the opportunity to reintegrate effectively into the society as restored victims.

            The benefits of the Victims Assistance and Involvement Program outweigh its costs. The federal government funds the victims assistance programs, taking substantial funds with the sole purpose of helping the victims settle within the society. Research indicates that Victim Assistance Programs are associated with increased psychological stability. According to Eckhardt et al. (2015), many victims of crimes suffer psychological challenges that can include depression and post-traumatic stress disorder (PSTD). However, the use of victim’s assistance programs has been shown to be effective in elevating such complex psychological conditions on victims. Given that crimes will never be eradicated, the victim assistance programs are not only important but offer a cheaper alternative than treatment of psychological effects of crime. The treatment of serious psychological problems such as PSTD can be very expensive to the family of the victims. The use of victim assistance programs offers a cheaper alternative to preventing such occurrences. For restorative justice program..

            The Victims Assistance and Involvement Program acts as a preventive program. Through the program, the victims are helped to settle into the community and continue with their life in a normal way. Without the program, some of the victims could easily sink into depression and PSTD, thus affecting the family and those who dependent upon them. It is imperative that an assistance program be provided to ensure they assume normal life. The program also acts as a way of preventing a possible economic challenge that could result from psychological conditions such as depression. Therefore, the benefits of Victims Assistance and Involvement Program outweigh the costs of running the program.
