Introduction

Studies have showed that cardiovascular disease is the leading cause of mortality in developed countries. Heart failure is one of the chronic diseases that disrupt everyday life of the patient, their families and the wider community. The patients and their families spend enormous resources to attempt to seek out the most effective strategies, support and information to manage the disease and minimize interruptions(Mainar, et al., 2015). The prevalence of heart failure in developed countries especially the United States, Australian and United Kingdom is high. Some of the common symptoms associated with heart failure include fatigue, peripheral oedema and breathlessness, which causes multiple interaction with daily life. Depending with the severity of the attack, the patient may develop multiple chronic co-morbidities which may require complex treatment regime.

World Health Organization has made the education of a patient to monitor their own health and being able to recognize illness severity as well as self-management of multiple chronic diseases as the current health care policy. Research have showed that symptom unpredictability leaves the patients to feel helpless and completely dependent on those around them, hence leading to lack of control on the illness and increasing the burden on the health care system and on the family(Fry, et al., 2016). In most circumstance, the responsibility for care shifts from the patient to the caregivers, spouses or immediate family. Under these conditions, the patient typically adopt to the ‘sick role’ thus depending on their families to provide support with their illness as well as in the previous responsibilities. During this time, a patient with greater levels of family support tend to build strong…..………………………………………………………………………………………………

Consumer Sovereignty in Health care

Consumer sovereignty in health care holds only when consumers have the powers to dictate what is produced in the health care system. This is not the case even in the industrialized or developed economies because the per capita health care expenditure in the United States are by far the highest(Sirgy, 2011). Statistics indicated that health care expenditures continue to grow geometrically, which is a suggestion that consumer sovereignty in health care is fiction. Analysis showed that health care system mostly uses consumer-based directed care, which was initially libertarian/market-based model. This model continues to increase disparity between the haves’ and have nots’.

Generally, consumer exercise their sovereignty in the marketplace to ensure the availability and adequacy of services. However, the applicability of sovereignty model in medical services market is marginally successful even in a sophisticated economy. One of the major reasons relates to the economic concept of need versus demand and the consequences of the consumer’s uncertainty about medical service product(Christensen & Wertheimer, 1976). Even the most knowledgeable and sophisticated consumers, they are hardly experts to evaluate the medical service or determine the best care to their needs. The prerogative of the medical practitioner predominate patients needs and desires. The other reason sovereignty model in health care has failed is the challenges encountered by patients in attaining access to the medical care market due to ethnocultural, economic and geographical barriers. Epidemiologic Triad

This is a triangle which consist of an external agent, a host and an environment. The host and agent are brought together, thus causing the illness to occur in the host. In this paper, epidemiologic triad for non-infectious disease was constructed(Harkness & DeMarco, 2016). Cardiovascular disease was chosen and epidemiologic triad was constructed using smoking as one of the main causes of the heart diseases(Heath, et al., 2008). When an individual smoke, he/she inhales carcinogen which is found in cigarette and it causes the disease. The vectors are those individuals who manufacture, sell and distribute the cigarettes. They bring the disease-causing agents to the susceptible host as shown in the figure below.

The epidemiologic triad above contain some potential interventions that may help minimize the prevalence of cardiovascular disease in the population(The Pennsylvania State University, 2018). For example, clean indoor air legislation, advertising potential harm from smoking as well as establishing workplace smoking cessation program leads to the change of the environment and reduces the exposure of host to agent. Contrary to these interventions, increasing the number of vendors, increasing advertisement and increasing the manufacturing of cigarette would increase exposure of host to agent.

Civil and alternative dispute resolution (ADR) process

Case Analysis

In light of your understanding of the civil and alternative dispute resolution (ADR) process, consider the following scenario:

Pete was seriously injured when the four-wheeled all-terrain vehicle (ATV) he was driving through the trails behind his house rolled over. As a result of his injuries, Pete is unable to work and has incurred $75,000 in medical bills. Pete has filed a lawsuit against the ATV manufacturer to receive compensation for the financial harm resulting from his injuries. Pete claims that the manufacturer defectively designed the ATV, causing it to have a tendency to roll over on rough terrain.

The ATV manufacturer claims that the ATV is not defectively designed and that the rollover was caused by Pete driving at an excessive rate of speed around a corner.

Consider the steps in civil litigation and ADR, and assess the factors that Pete and the ATV manufacturer will consider when deciding whether they should settle this lawsuit. If you were Pete’s lawyer, what resolution would you advise? Be sure to consider the primary forms of ADR and all ADR factors described in the lesson and textbook.

Finally, research and select at least one case from an outside source to support your resolution to the ATV case. Include an introduction in your paper.

Your answer must be at least two pages in length. Adhere to APA Style when creating citations and references for this assignment. APA formatting, however, is not necessary. See Civil and alternative dispute resolution

Assignment

Introduction

After getting involved in an accident while driving a four-wheeled all-terrain vehicle (ATV) in his backyard, Pete claimed that ATV manufacturer defectively designed the vehicle and it led to roll over on rough terrain. Pete the plaintiff was therefore seeking for a compensation from ATV manufacturer for the cost he incurred as medical bill and injuries he sustained, which made him unable to carry out his normal duties. The defendant responded to the claims that ATV was not defectively designed and the roll over was attributed to excessive rate of speed around the corner. To effectively analyze this case, it is important to understand the facts.

While making the determination of this case, there are several factors that courts should consider about Pete and ATV manufacturer. One key factor that court need to consider is whether the plaintiff have presented enough evidence to prove that the accident indeed occurred as a result of ATV defective designs(Kubasek, et al., 2016). Pete also should consider whether the case can stand the threshold of requirements, ripeness, and justifiable controversy. These are the facts that determines whether the case could come before the judges in the court of law.             On whether the ATV manufacturer should settle the dispute or not, the company should establish whether there is legitimacy in the…………………………………………………………………………………………………

HRD Process Model (ADDIE Model) systematic

Topic 1: SHRM Content Area (Organizational Development: Action Research) Action Research One systematic approach used in Organizational Development is the HRD Process Model (ADDIE Model) as it is a systematic approach intended to improve the effectiveness of an organization. The Assessment phase of the HRD Process Model (ADDIE) is particularly relevant as it used to identify gaps in organizational effectiveness between an organization’s current and desired state. This discussion will review another systematic approach used in Organizational Development, Action Research. Action Research can be understood as a process, model, theory, or set of techniques. Most often, Action Research is framed as action taken by an external consultant, which is why Figure 18-1 utilizes Organizational Development consultant language. However, Action Research can also be used by internal HRD professionals, the steps are the same. You will find the Action Research Model useful both in Organizational Development, and in other areas of your professional and personal life. Action Research is built on feedback. A problem is identified, data collected, a diagnosis given, a plan developed, action taken…followed by assessment/data…which is used to continue the process. That feedback data is immediately used to identify the problem and the process resumes. Figure 18.1 in Organizational Behavior in Health Care, Chapter 18 (Borkowsi) identifies the eight steps in Action Research. Table 18.1 displays these eight steps (Burke, 1982) simplified into four steps as developed by Cummings and Worley (1997). How would you apply the 8 steps of Action Research to the organization you are using for the course project? What value might Action Research add to your course project? How might your organization respond to Action Research and why? Topic 2: SHRM Content Area (Organizational Development: Appreciative Inquiry) As reviewed in the previous discussion topic, the HRD professional needs skills in both Change Management and Organizational Development (OD). Change Management focuses on the human component of organizational change, and Organizational Development focuses on planned processes of change using a systematic approach to increase organizational effectiveness. One such planned process using a systematic approach is Action Research; another is Appreciative Inquiry. While Action Research focuses on what is going wrong in an organization, the Appreciative Inquiry systematic approach centers on what the organization is doing right. Appreciative Inquiry is often expressed as having five components. Both the Organizational Development Fundamentals Figure 2.4 (Rothwell, et al., 2015, page 7) and the Organizational Behavior in Health Care (Borkwoski, 2017, page 10) address Appreciative Inquiry. Rothwell uses the 5 D Appreciative Model and Borkwoski uses the 4 D Model. The center of Appreciative Inquiry is the way diagnostic questions are asked. What is different about the questions used in Appreciative Inquiry? Would you use the 4D or 5D Model for the organization you are using for your course project and why? Would the Action Research Model or the Appreciative Inquiry Model have more value for the organization you are using for your course project? Why?

Organizational Development: Action Research

Topic 1

According to Johnson (2008), the eight steps of action research serve as guideline when conducting action research project. Therefore, it is very imperative for the action research to adapt to a particular research topic or problem. In other words, the eight steps should not be seen as cast in stone, it should be flexible. The 8-step action research are identifying and limiting the topic, gathering information, reviewing the related literature, developing a research plan, implementing the plan and collecting data, analyzing the data, developing an action plan, and reflecting on the process.             The application of action research in the organization follows a systematic process, with the first step being identifying a specific problem. In this case, the organization is a learning institution, and the action research project is to improve performance of the students(Morrissey, 2013). This can be achieved through the use of examination and trial of the alternative instructional approach. The second step involves gathering information, where the views and instructional approach of tutors is obtained. It is…………………………………………………………………………………………………

Cellular and Sub-Cellular Processes of Excitation

All the people owe much to the feeling in their lives owing to the beating of their hearts. Schlüter (2016) points out that the heartbeats are products of cellular mechanisms of excitation-contraction (EC) coupling. The excitation-contraction coupling has since become a critical component of the pathology and cardiac physiology. Consequently, it has led to a greater interest in the understanding of the sub-cellular, cellular, and even the molecular pathways of the cellular excitation process.

The Excitation-Contraction (EC) Coupling

The concept of the excitation-contraction (EC) coupling has been defined as the processes at the cellular level that precedes electrical excitation leading to the activation of the myofilaments (Schlüter, 2016). The excitation-contraction (EC) coupling has been found to control the cardiac and skeletal muscles, with some notable differences. Plopper et al. (2015) point out that the resting muscles cells have a much-reduced concentration of Ca2+ in the cytol in comparison to the concentration outside the cell and inside the SR Ca2+ storage organelles. When the excitation-contraction (EC) coupling commences, the Ca2+ enters the cytosol and exits it as the cell starts to enter the resting position. The process creates an increase and reduction of cytosolic Ca2+ concentration that goes on in the cells. The process of the repeated increase and decrease in the Ca2+ cytosolic concentration is termed as the Ca2+ transient.

The process of excitation-contraction (EC) coupling in a cardiac cell is divided into four major steps. According to Plopper et al. (2015), the first step is the initiation of a signal at the sarcolemma through the process of polarization. During this process, a potential is created when the membrane becomes more positive relative to its resting potential due to an incoming action potential. The Cav channels that are voltage-dependent sense the change in membrane potential thus opening during the second phase of the cardiac action potential. The result is a flow of the calcium ions (Ca2+)through the established electrochemical potential and down into the cell. The second phase is the calcium ions (Ca2+) influx through the Cav 1.2 Ca2+ channels that are responsible for the stimulation of the release of Ca2+ from the SR Ca2+ organelle (Plopper et al., 2015). The SR Ca2+ organelle has been found to have storage of calcium ions in millimolar concentration. Schlüter, 2016,) points out that the excitation and contraction of the cardiomyocytes are linked with the change in the concentration of the Ca2+. The process begins with the triggering of the Ca2+ release from the sarcoplasmic reticulum. This leads to the sarcolemmal Ca2+ influx leading to an increase in the intracellular Ca2+………………………………………………………………………………………………

Consumer Decision Making Process

Marketers can develop effective marketing strategies if they have a good understanding of the consumer though processes. Although it may not be easy to comprehend, consumers have a decision processes that they employ while making a purchase decision. The development of a good understanding of the process is critical for marketers. The understanding is important in developing a structured thinking and a better understanding of the consumer behavior. The consumer decision process model describes the steps that a consumer or purchaser follows while making their purchase decision.

Part 1: The Decision Making Process

The purchasing process has been shown to be similar to process of problem solving. According to Verma (2008) customers purchase a product or service when they have a need that they need to satisfy. The purchasing decision has been shown to follow a series of steps, which has been referred as the consumer decision-process model. The consumer decision process consists of the need recognition, information search, pre-purchase evaluation, purchase, consumption, and post-purchase evaluation. The need recognition occurs where the consumer initiates the decision to make a purchase. This could occur due to perceived discrepancy between the current and desired states. For example, a desire to buy new mobile device in order to access more content that cannot be accessed by an old model. The recognition of the need is followed by the search for information about the available alternatives. According to Hoffman & Bateson (2010) the search can be internal or external. The collected information can be obtained from personal and non-personal
