Accusation of Sexual Harassment in Pro Sports

Read the case, Accusation of Sexual Harassment in Pro Sports and the following Wells Fargo case to answer this week’s questions under the Discussion Board.

Accusation of Sexual Harassment in Pro Sports:

The jury in a sexual harassment suit brought by a former high-ranking New York Knicks basketball team executive awarded her more than $11 million in punitive damages.  Officials of Madison Square Garden (which owns the Knicks) said they would appeal the verdict.  However, even if they were to win on appeal (which one University of Richmond Law School professor said was unlikely), the case still exposed the organization  and its managers to a great deal of unfavorable publicity.

The federal suit pitted Anucha Browne Sanders, the Knicks’ senior vice president of marketing and business operations (and former Northwestern University basketball star), against the team’s owners, Madison Square Garden, and its president, Isiah Thomas.  The suit charged them with sex discrimination and retaliation.  Ms. Browne Sanders accused Mr. Thomas of verbally abusing and sexually harassing her over a 2-year period.  She said the Garden fired her about a month after she complained to top management about the harassment.  At the trail, the Garden cited numerous explanations for the dismissal, saying she had “failed to fulfill professional responsibilities.”  At a news conference, Browne Sanders said that Thomas “refused to stop his demeaning and repulsive behavior and the Garden refused to intercede.”  Mr. Thomas vigorously insisted he was innocent.  According to one report of the trial, her claims of harassment and verbal abuse had little corroboration from witnesses but neither did the Garden’s claims that her performance had been subpar.  After the jury decision came in, Browne Sander’s lawyers said, “This [decision] confirms what we’ve been saying all along, that [Browne Sanders] was sexually abused and fired for complaining about it.”  The Garden’s statement said, in part, “We look forward to presenting our arguments to an appeals court and believe they will agree that no sexual harassment took place.

Wells Fargo Case:

DES MOINES, Iowa (AP) — Wells Fargo Home Mortgage (WFC (Links to an external site.)) has fired a Des Moines worker over a 1963 incident at a Laundromat involving a fake dime in the wake of new employment guidelines. Richard Eggers, 68, was fired in July from his job as a customer service representative for putting a cardboard cutout of a dime in a washing machine nearly 50 years ago in Carlisle, the Des Moines Register reported (Links to an external site.) Monday. Warren County court records show Eggers was convicted of operating a coin-changing machine by false means. Eggers called it a “stupid stunt,” but questions his firing. Big banks have been firing low-level employees like Eggers since new federal banking employment guidelines were enacted in May 2011 and new mortgage employment guidelines took hold in February, the newspaper said. The tougher standards are meant to clear out executives and mid-level bank employees guilty of transactional crimes — such as identity theft and money laundering — but are being applied across the board because of possible fines for noncompliance. Banks have fired thousands of workers nationally, said Natasha Buchanan, an attorney in Santa Ana, Calif., who has helped some of the workers regain their eligibility to be employed. “Banks are afraid of the FDIC and the penalties they could face,” Buchanan said. The regulatory rules forbid the employment of anyone convicted of a crime involving dishonesty, breach of trust or money laundering. Before the guidelines were changed, banks widely interpreted the rules to exclude minor traffic offenses and misdemeanors. Wells Fargo confirmed Eggers’ termination. “The expectations that have been placed on us and all financial institutions have never been higher,” said Wells Fargo spokeswoman Angela Kaipust. The Federal Deposit Insurance Corp. provides a waiver process employees can follow to show they’re still fit to work at a bank despite a past criminal conviction, but it usually takes six months to a year to be approved. There is also a process for automatic waiver that works more quickly but is limited to people who were sentenced to less than year of jail time and never spent a day locked up. Eggers, who was jailed two days, doesn’t qualify. American Bankers Association spokeswoman Carol Kaplan said the public clamor for tighter regulation also is responsible for the stricter interpretation of the rules. The safest route is to fire the employee and let them pursue an FDIC waiver. “There’s no question that there was an appetite for tighter bank regulation as a result of the global financial crisis,” Kaplan said. There is no government or industry data on the number of bank firings due to criminal background checks. The FDIC is on pace to grant 74 waivers, up from 21 waivers approved in 2009. The agency was not able to provide any information on annual waiver application data. Des Moines attorney Leonard Bates is helping Eggers navigate the FDIC waiver application process. “These guidelines are really meant for executives and people who can perpetuate widespread fraud,” Bates said

Opportunities arise from C&C Sports’ current weaknesses AND strengths combined

relpy to this post with at least 200 words and citation

C&C Sports is a family and locally owned sport uniform company based in Texas since 1928. Their company started as a sewing operation with intents to provide clothing to workers. Over time, the company found a market niche in manufacturing baseball unforms and has attributed their continuous success to that. The company is run by the third generation of leadership with relatives running certain management positions.

In conducting a strengths analysis, we find that they are local and do not outsource operations from China. Because of this, they have grown favoritism throughout Texas and have grown a loyal fan base. Product delivery/shipment is also quick and reliable. C&C sports also has a ongoing connection with other vendors in the chain such as Universal Sports which offers marketing, less shipment costs, and additional sales for C&C Sports. Also, due to it’s history and close accounting records, C&C sports has been able to continuously generate income despite sales declining because they were able to understand what to do and that is create less clothes and ultimately, have production expenses reduce.

A weakness analysis displays a lower operating income percentage because it is a smaller firm and therefore can only produce so many clothes and income. In fact, there seems to be an ultimate decline in cash from operations despite income increasing and inventory increasing. There also seems to be a lack of growth and general expansion nationwide as their current business is staying stagnant.

Opportunities arise from C&C Sports’ current weaknesses AND strengths combined. Expansion is necessary in order to generate more revenue. C&C is so customed to occupying their current market niche (baseball apparel) and should look into alternate markets like other sport apparel and equipment even. The company can maintain its core values of not outsourcing but they should look into expanding and networking into other states/stores. The company also should pride themselves on their excellent customer service and high quality items and use those as a main selling point when they do venture into other markets. The company can also utilize various marketing tools from the internet and social media to display their brand.

Threats arise from alternate competitors or sport apparel stores that have been able to carry more than just baseball apparel. Overall, these competitors have occupied a certain portion of the market and C&C’s revenue even if C&C carries exclusive baseball attire (not found in other stores). Another threat that is incoming is the gradual decrease in sales due to the unbalanced operating income percentage. The company should also look into investing into operating activities as their current cash balance is decreasing despite their current method which is trading long term debt for short term debt is only a short-term solution.

It is crucial for C&C Sports to analyze their current financial reports and statements to identify where their strengths can be further utilized and how to correct their weaknesses. It is also important to identify whether or not the third generation President is fully mentally invested and capable in the job as he may no longer what a part of the business and is holding it back. “Thus, it is time to analyze the business’ opportunities and directions to ensure an appropriate match of management and leadership talents with the needs of the company” (Fritz, 1997).

To identify the most important qualities shared by outstanding sports writers

INTRODUCTION

Outstanding sports writers possess a variety of different skills.

The first part of this assignment asks you to examine a piece of quality sports writing and identify some of the key writing skills that went into it.

The second part of this assignment focuses on cliches.

A cliche is defined as “a phrase or opinion that is overused and betrays a lack of original thought”.

Cliches are used as a crutch by both athletes and broadcasters.

You should try to eliminate using cliches as much as possible in your writing.

**NOTE: THIS IS A TWO-PART ASSIGNMENT**

OBJECTIVE

  • To identify the most important qualities shared by outstanding sports writers

       You’ll do that by:

       1) Analyzing an example of sportswriting of your choice

       2) Creating a Top 10 list of qualities associated with outstanding BROADCAST WRITERS

  • To identify cliches and replace them with more original language in your copy

ASSIGNMENT REQUIREMENTS

PART I :

**(PART II INSTRUCTIONS ARE NEAR THE BOTTOM OF THE PAGE.  MAKE SURE YOU COMPLETE BOTH PARTS OF THE ASSIGNMENT)**

To complete the first part of this assignment, you must find an example of great sports writing.

Your writing sample can showcase either broadcast writing or print writing (broadcast is preferred).

Surf sports websites or do a Google search to find the article or video you plan to use for this assignment.

**If you pick a broadcast writing sample, you will need to send me a link from your video source.  You do NOT need to have the script written out- just send me a video sample.**

NOTE:  Sports debate shows generally aren’t scripted, so do NOT use the debate portion of a debate show for your example.  Find something you know is likely scripted (Examples: Scott Van Pelt’s “One Big Thing”, introductions to highlights on SportsCenter, “Face Time” on Around the Horn, local sportscasts).

Prepare a three-to-five minute presentation video breaking down:

1) Why the sample you’ve chosen is effective

2) Why it’s an example of great sports writing

The entire presentation video will be based on your own personal opinion.

*Begin your presentation video by explaining the piece of outstanding sports writing you chose.

*Be sure to include WHY THE SAMPLE YOU’VE CHOSEN IS EFFECTIVE  and WHY IT’S AN EXAMPLE OF GREAT SPORTS WRITING.

NOTE:  If you choose a broadcast writing clip, you do NOT need to include video of the example of outstanding sports writing you chose in your presentation video.  You have the option of including clips of your sample if you want to, but it is NOT MANDATORY.

Part of your presentation video MUST include you on camera performing your material.

*Conclude your presentation video by *reading over* EITHER GRAPHICS OR KEYNOTE/POWERPOINT SLIDES listing your Top 10 list of qualities associated with outstanding BROADCAST WRITERS (note: not broadcasters, BROADCAST WRITERS) and *summarize what each quality means*

**Your Keynote (or PowerPoint) slides need to be edited into your project if you choose to use them.**

**After you show us your Top 10 list in your presentation video, point out which qualities in your Top 10 list were displayed in the writing sample you chose and specifically explain WHERE THEY WERE USED in the piece of writing you chose.**

Again, be sure to edit the Keynote (or PowerPoint) slides into your project on iMovie (or another editing program you’re comfortable with).

*The Keynote slides should match the audio they’re paired with and should appear in the appropriate portions of your presentation video.*

**To do create a video of your slides for editing purposes, create a Keynote (or PowerPoint) presentation with slides for your Top 10 qualities.  Go to the top of the page and click on “File” (make sure you’re in the Keynote or PowerPoint program before you do this).  Bring your cursor down to “Export To” and then click on “Movie”.  You’ll be given options for when to go to the next slide and have any “builds” come onto the screen.  I recommend changing the settings to give you 15-20 seconds between slides to give you more leeway for editing them.  Once you’ve created your movie file, upload it into iMovie (or whatever editing program you’re using) and proceed to edit the clips into your presentation video.**

**PART II INSTRUCTIONS- REMEMBER: YOU NEED TO COMPLETE BOTH PARTS OF THIS ASSIGNMENT**

PART II:

To complete the second part of this assignment, follow the instructions below:

1) Read the script below and identify the cliches embedded within it:

WHEN IT COMES TO HOCKEY… WAYNE GRETZKY IS IN A LEAGUE OF HIS OWN.

THE CANADIAN SUPERSTAR HAS BEEN ON TOP OF HIS GAME SINCE HE WAS A TEENAGER… AND NO ONE WILL EVER SURPASS HIS DOMINANCE IN THE SPORT.

SKILLED, SMART, AND POSSESSING THE HEART OF A CHAMPION… GRETZKY WON FOUR STANLEY CUPS… AND RETIRED WITH MORE THAN SIXTY N-H-L STATISTICAL RECORDS.

YOU CAN’T SAY ENOUGH ABOUT HIM.

WAYNE GRETZKY’S MORE THAN JUST “THE GREAT ONE”.

 HE’S “THE GREATEST ONE”.

REMEMBER: A cliche is defined as “a phrase or opinion that is overused and betrays a lack of original thought”.  Cliches are used as a crutch by both athletes and broadcasters.  You should try to eliminate using cliches as much as possible in your writing.

2) Rewrite the script replacing the cliches with original language

3) Send me your script in a Word or PDF document

4) Record yourself on camera reading your new script, and send me the video file of your recording

*PLEASE READ YOUR SCRIPT OUT OF THE TELEPROMPTER PROGRAM ON RUNDOWN CREATOR SO YOU CAN GET PROMPTER PRACTICE*

**You should’ve received an email with you Rundown Creator account information.  Click the link in your email to get started.  Then head to https://www.rundowncreator.com/fullsail/Login.php to use the program.**

HERE’S A LINK THAT EXPLAINS EVERYTHING YOU NEED TO KNOW ABOUT RUNDOWN CREATOR:

You need to upload and submit the following items:

1) The example of great sports writing you’ve selected in a PDF document with a link to your source

**Remember- If you picked a broadcast writing sample, you will need to send me a LINK OF THE VIDEO.  You do NOT need to have the script written out- just send me a video sample.**

2) Your presentation video (uploaded directly to FSO)

**NOTE:  There is a 500 MB limit for uploading files in FSO.  If your file is over that limit, either reduce the file size (Google how to do this- one program you can download is https://handbrake.fr/ OR upload your video to YouTube and send me the link via FSO message)**

3) A Word or PDF document of the script you rewrote that replaces cliches with original language

4) A video of you performing your new cliche-less script from Part II of this assignment (upload this video directly to FSO)

*DEADLINE: Sunday, January 12, 11:59 p.m. (EST)*
